La “razionalità giuridica” dell’effettività: profili della normativa europea sul digitale

In light of the multidimensional nature of the challenges posed by the digital transition (affecting both, fundamental rights and freedoms and democratic processes) European legislation must be carefully assessed in terms of its regulatory “performance.” In this respect, the “metrics,” both technical and legal, developed to support the effectiveness of legal provisions acquire constitutional relevance. To this end, two similarly proceduralized methodologies are considered: the first, implemented by the European legislator through Better Regulation; the second, implemented by Courts through the proportionality test, which in turn underlies the principles of legal certainty and legality. On the basis of this premise, the paper seeks to highlight whether, and to what extent, certain provisions of the European digital legislation strike a balance between “technical rationality” and “legal rationality,” thereby ensuring their regulatory “performance” in terms of effectiveness, and thus proportionality, legal certainty, and legality, for the “maximization” of the protection afforded to fundamental rights and freedoms.
