L’autonomia normativa universitaria: alcune riflessioni per un’analisi critica sul sistema delle fonti dell’ordinamento universitario

This essay aims to offer an analysis of university regulatory autonomy that goes beyond a descriptive reconstruction of the topic. Through an examination of the main legislative interventions – from Ruberti Law (Law No. 168 of 1989) to the Italian National Recovery and Resilience Plan (NRRP/PNRR) – which have progressively reduced the autonomy granted to universities, and through a comparison between the Statutes and General Regulations of the University of Turin and the University of Eastern Piedmont, this work provides the reader with a tool to critically reflect on the (un)implementation of the academic autonomy in current institutional and political context. The decision to focus the analysis on the issue of university regulatory autonomy responds not only to systematic considerations but, above all, to the conviction that the preservation and implementation of the principle recognized in Article 33, paragraph 6, of the Constitution mainly depends on the dynamics that govern the system of legal sources.
