La disciplina della forma di governo nello Statuto della Regione Liguria tra vincoli costituzionali e tentativi di razionalizzazione statutaria

This article examines the discipline of the form of government in the Statute of the Liguria Region, twenty years after its entry into force, within the framework established by the 1999 Italian constitutional reform. Although Article 123 of the Constitution formally grants ordinary Regions autonomy in defining their institutional structure, constitutional case law has significantly limited this autonomy, leading to the consolidation of a largely uniform model. Against this background, the article analyses the Ligurian experience as an attempt at statutory “rationalization” of the regional form of government. It focuses on three areas: the regulation of the confidence relationship, the guarantees afforded to opposition groups, and the allocation of regulatory powers. The study shows that, while the Statute introduced some corrective mechanisms aimed at strengthening the Regional Council and protecting minorities, these measures have not substantially altered the structural predominance of the executive. The Ligurian case thus highlights both the potential and the limits of statutory autonomy in rebalancing regional institutional dynamics.
