Il controllo di legittimità sulle raccomandazioni dell'Unione europea

The article analyses recommendations of European Union Law in order to determine whether and when they produce binding legal effects and, therefore, whether an action for annulment under Article 263 TFEU can be brought against them.
So, while clearly described as not binding, recommendations can generate considerable legal effects, in the sense of inducing certain behavior and modifying normative reality. They are likely to have an impact on the rights and obligations of their addresses and third parties. These effects can be produced on two distinct but interconnected levels: the European Union Law and the Member States Law.
However, it is necessary to examine the substance of the act and to assess those effects on the basis of objective criteria, such as the content of that act, taking into account, as appropriate, the context in which it was adopted and the powers of the institution which adopted the act.
So, only measures adopted by the institutions, whatever their form, which are intended to have binding legal effects, are regarded as actionable measures within the meaning of Article 263 TFEU. Any act not producing binding legal effects, but only legal effects, such as mere recommendations, falls outside the scope of the judicial review provided for in Article 263 TFEU.

The text compares the laws approved in the first year of the seven legislatures in which the so-called "Second Republic" (1994-2019) has so far been articulated. The number of laws is analyzed considering the time required for the formation of the Government and the establishment of standing Committees; the type of laws is also described. Particular attention is paid to laws containing delegated powers to the Government, which open wide reform processes: the presence of large delegated procedures would in fact seem to be a useful indicator of the duration of the legislatures.

This essay concerns the electoral laws which are necessary, according to Constitution, in order to elect the essential organs of State as well as of substatal bodies; therefore, it points out that the mere caducation of these laws is forbidden to abrogative referendum, to Constitutional Court and to the legislator itself.

The essay concerns the relationship between the Italian legal system and the Italian sport ‘para-legal’ system, starting from the approval of the Law-Decree October 5, 2018, n. 118.
The last summer Italian football suffered a serious crisis due to the malfunctioning of the ‘replenishment system’, which was supposed to face the shortage of Serie B championship, caused by the failure of some teams. The Law-Decree n. 118/2018 cancelled the jurisdiction of sport judges over all disputes related to the registration for pro-fessional football leagues, giving it to state administrative courts.
The Italian Parliament did not approve the Law saving the effectiveness of the Law-Decree October 5, 2018, n. 118. As a result, the relationship between the sport system and the state system turned into the same relationship existing before the fifth of October.
After a few weeks, anyway, the Parliament passed the budget law, with the content of the Law-Decree October 5, 2018, n. 118.
The essay deals with all the consequences, in terms of constitutional legality, that derive from this affair; in particular, the paper assumes that the responsibility for the 2018 summer Italian football crisis should not be at-tributed to the sport justice system but to the system of sport rules, that was unclear.

Obsolescenza programmata dei prodotti e dei dati personali

SOMMARIO: 1.Introduzione epistemologica del tema dell’obsolescenza programmata come osservatorio delle fonti “dal basso”. Nozione di obsolescenza programmata; espressa previsione solo nell’ordinamento francese; distinzione dalla obsolescenza dei beni strumentali rilevante nell’ ordinamento italiano. – 2. Possibilità di obsolescenza programmata coinvolgente anche beni strumentali aziendali; ulteriori precisazioni sulla obsolescenza tecnologica. – 3. This paper seeks to examine the legal nature of planned obsolescence of products which has become a typical phenomenon of the consumer society. It will present the regime currently set out for the obsolescence of capital goods, then it will turn at addressing the following issues: can planned obsolescence be treated as a latent defect of the goods sold? How can we classify a smartphone, based on the conclusions of the September 25th, 2018 decision of the Italian Competition Authority which declared an unfair commercial practice the planned obsolescence of Apple’s and Samsung’s devices? Furthermore, having considered that the profiling of personal data is nothing more than a product, we will discuss the issue of planned obsolescence of personal data, in view of the digital profiles elaborated by big data analytics.

Someone to Talk to? The Non-Use of the US Supreme Court Precedents in the Case Law of the Court of Justice of the European Union

This article deals with cross-fertilization as the use made by courts of foreign and international legal sources. More specifically, it focuses on the use of the US Supreme Court precedents made by the Court of Justice of the European Union. By scrutinizing the latter’s case law and proving that, as a general rule, it has referred to the US Supreme Court decisions in a merely ornamental fashion, it provides reasons to be-lieve that, as far as the relation between the US Supreme Court and the Court of Justice of the European Union, cross-fertilization is just an illusion or, on a more positive note, a mere aspiration that has not been achieved yet.
