La natura funzionalizzata della legge di conversione del decreto-legge: riflessioni sui recenti orientamenti della Corte costituzionale

The essay investigates some issues concerning the relationship between the so called «decreto-legge» (decree-law) and the statute which has the specific function of “converting” the decreto-legge in parliamentary legislation («legge di conversione»), in the light of the recent jurisprudence of the Italian Constitutional Court. The Court asserts that the decreto-legge and the legge di conversione are related, and that the two acts must be homogeneous. Due to the fact that the Court's assertions imply that the Parliament is partially bound in its prerogatives, it seems important to consider the constitutional basis for these assertions.

L’eredità costituzionale di Next Generation EU e del Piano Nazionale di Ripresa e Resilienza: elementi per un primo bilancio prospettico

This paper aims to draw a first, and necessarily provisional, balance about the potentially long-lasting repercussions of the Next Generation EU and the NRRP on the Italian legal system, with particular regard to the formation and implementation of policy. From this point of view, we will first analyse the form of government, in an interpretative key that moves from the assumption of the interdependence between national and European institutions, assuming as a working hypothesis the stabilisation of the "NRRP model" (in the terms that will later be specified) within the new European economic governance. Attention will then be focused on the processes of normative production, and in particular on decrees-law, because of the biunivocal link that binds the legal system, on the one hand, with the form of state and the form of government, on the other. In the same logic and in strict consequentiality with the first two parts - looking at regulations and bureaucratic offices as instruments for defining and implementing policy - the aspects connected with regulatory simplification and administrative simplification will finally be dealt with.

Taking inspiration from the transformations of law as a reaction to "exogenous" factors, this paper focuses on two regulatory techniques: nudge regulation and technological management. While briefly describing their main features, the aim is to highlight two aspects that, in the author's opinion, require further consideration from a constitutional perspective: one concerning individual freedoms, and the other concerning the relationship between powers (i.e. legislative and executive).

Decreto-legge e ordinanza di rinvio a data fissa. Ovvero: come scongiurare il sorgere dell’ennesima prassi abusiva in tema di decretazione d’urgenza

The essay focuses on the constitutional issues arising from another distorted practice in the area of emergency decrees: decree-laws that follow up on fixed-date adjournments pending the legislature's measure, even though the measure required by the Court should have been implemented by parliamentary law and not by government decree-laws.
