Le norme pattizie come parametro di costituzionalità delle leggi: questioni chiarite e questioni aperte a dieci anni dalle sentenze "gemelle"

SOMMARIO: 1. La base di partenza: la rilevanza dei trattati nell'ordinamento italiano fino alla revisione costituzionale del 2001. - 2. The Italian Constitutional Court's decisions n. 348 and 349 of October 2007 - the so-called "twins judgments" - marked a major step forward in the direction of opening up the Italian legal order to international obligations stemming from treaties to which Italy is a party. In the last decade, some arguments made by the Constitutional Court in 2007 received important clarifications by the subsequent constitutional jurisprudence, such as the fact that the treaty rules must be interpreted as rules belonging to an external legal order (i.e. international law) when they come into play as a constitutional parameter, as well as their "sub-constitutional" character, which prevent them to function as a constitutional parameter when their content is not in conformity with the Italian constitution. On the other hand, some problematic issues, which are strictly linked to the Constitutional Court's approach in the "twin judgments", still deserve to be clari-fied. This is the case with the identification of the kind of treaties that fall within the category of constitutional parame-ters, according to Art. 117.1 of the Italian Constitution. And this is also the case with the extent of the power of ordi-nary judges to resolve possible antinomies between internal legislation and treaty rules, without submitting the issue of constitutionality to the Constitutional Court.
