The legal text, starting from the article of law relating to the scrolling of rankings, identified as a possible alternative to the calling of new public competitions, will analyze the regulatory framework of reference, in the light of recent interpretations of administrative, civil and accounting jurisprudence. The relationship between the right to scroll of those candidates usefully placed in the ranking (although not winners) and the power of the administration to announce new recruitment procedures will then be clarified.

This essay analyzes the sources lato sensu and the ongoing reforms on telemedicine. It is necessary to concretely implement a simplified management of these new assets of the care relationship, in the interest of the promotion of health. In the absence of a uniform legislation, telemedicine services are partly governed by sectoral regulations, including best practices and guidelines, which should be approached with prudential criteria, considering them necessary to reflect on the structure of sources in this area as well as on the introduction of a primary source. This research work focuses on the mapping of e-Care networks, on the doctor's responsibility and on his decision-making discretion in telemedicine, in light of the principle of self-determination and patient empowerment. The national guidelines for telemedicine services offer a new partial classification as well as a system of administrative rules for the provision of remote health services, linked to the LEA. Validation of telemedicine modules depends on compliance with legal principles. The PNRR is intended to finance the creation of a national platform or federated platforms, through the adoption of standards for the efficiency of the digital public health system.

The contribution focuses on a recent opinion of the Advisory Section for Regulatory Acts, recently published, on a draft government regulation. The opinion presents aspects of undoubted interest, tackling important issues relating to the identification of regulatory power and the limits of delegation, at a time when the contents of Article 17 of Law 400/1988 and the attempt to bring secondary regulatory acts of the Executive under this provision are in crisis.

The paper analyses the decision of the ECJ in the case EPSU v. Commission. The decision is interesting because, in addition to writing a new page on the role of social dialogue at European level, it incidentally touches on various issues of institutional law and addresses issues related to the exercise of certain fundamental rights enshrined in the Charter. After having reconstructed the legal framework of the case and discussed the previous decision of the General Court, the paper focuses on the decision in question, considering the legal reasoning developed by the Court of Justice. In order to do so, it will be addressed the several arguments connected with the role of the social parties and the Commission in the regulation of the social policy in the EU. Finally, some critical considerations will be addressed on the most relevant aspects that emerged by the sentence.

This essay carries out some critical reflections regarding sentence no. 240/2021 of the Constitutional Court. In this ruling, the Constitutional Court once again dealt with law no. 56/2014 by carrying out a revirement with respect to the previous decisions. This essay focuses on the position taken by the Constitutional Court with regard to the identification ope legis of the Metropolitan Mayor and the consequent warning it addressed to the lawmaker.
